There are a lot of accidents where the police report and the client's version of events are different. As lawyers, we want to understand if there are any inconsistencies or if they've left out any important information to help find the truth behind your motor vehicle injury case.
The first thing we would do is to see whether or not there are any witnesses listed in the police report. We will try to get the witnesses' information so that we can get a statement from them. If there are competing stories to the accident, a witness statement is very helpful in terms of trying to resolve issues of liability and how it occurred.
What other evidence did the police collect? Did they look at the vehicle? Did they see if there were any rub marks on it or any transfers? Was the car dirty? Did our client take photographs or anybody take photographs at the scene of the accident? Because sometimes you'll find some information there.
Was the injury consistent with a trip and fall? For us, we looked at the injury itself to see if it is consistent with a trip and fall? Having it looked at by a biomechanical engineer, who is an engineer that studies how forces act on the body. We are usually able to determine if it’s possible to get that kind of fracture from just simply tripping and falling or if the injury was the result of a motor vehicle accident.
