Many in divorce and family law matters can fall into the trap of trying to convince opposing counsel of their side of the case. It can happen in a deposition where the lawyer for the opposing counsel takes on the role of good cop. It can happen in discovery responses where they start over-sharing. Sometimes, it happens in settlement negotations out of an urgent desire to settle the divorce or family law matter. Ultimately, the other attorney is a paid advocate for a party's spouse, ex-spouse, or whoever the opposing part may be. It is important for a party to never forget that this is the case.
